Data protection

1. Privacy

Protecting your privacy is important to LEADING SWISS AGENCIES (hereinafter LSA). Please note the following data protection regulations.

2. Scope

LSA collects, processes, stores, and protects the data of people who access its website. This privacy policy applies to this website and all applications and features of the same as “My LSA.”

3. Legal bases

The present data protection principles are based on the Swiss Data Protection Act (DSG) and the European General Data Protection Regulation (GDPR).

4. Responsibility at LSA

Responsible for all data protection issues at LSA is: Audrey Arnold, Managing Director LSA: audrey.arnold (at) leadingswissagencies.ch

The data protection officer for Switzerland and the EU is: VSG Datenschutzpartner UG, Am Kaiserkai 69, 20457 Hamburg Germany. info@datenschutzpartner.eu / https://datenschutzpartner.eu

5. Use of information

It is generally possible to visit the LSA website without providing any personal data. Impersonal usage data such as the IP address, the browser used, date, time, etc. are evaluated without drawing any conclusions about you personally.

Visitors to our website can also activate the “do not track” function on their browser so that only the login as such is tracked.

Personal data is collected and processed strictly in accordance with relevant laws and regulations and, in principle, only with your express consent.

6. No transfer of personal data

Your personal information is neither sold nor shared with third parties outside of LSA. An exception may be external service providers who process inquiries or orders (e.g. for studies or white papers) on behalf of LSA and process the necessary data for this purpose. LSA ensures that all data recipients meet data protection and data security requirements.

7. Contact options via the website

If you contact LSA via our website, the personal data you provide will be automatically stored. Such data provided on a voluntary basis will be stored for the purpose of processing or contacting you. There is no transfer of this personal data to third parties.

8. Comment and debate function

On our website, you can participate in interactive forums such as chat, blog, message board, and other platforms. You have the option to leave individual comments on contributions from other visitors and to conduct debates on specific topics. These comments can in turn be commented on by third parties.

If a data subject leaves a comment on an article or comment published on this website, in addition to the corresponding comment, information about the time the comment was entered and the name of the person concerned (real name requirement) are stored and published. In addition, the IP address assigned by the data subject's Internet service provider is also logged. The IP address is stored for security reasons and in the event that a comment infringes the rights of third parties or posts illegal content. There is no transfer of this collected personal data to third parties unless such transfer is required by law or serves to defend the rights of the person responsible.

9. Routine deletion and blocking of personal data

LSA processes and stores personal data of data subjects only for the period necessary to achieve the storage purpose, or if this is provided for by legal requirements to which the responsible parties are subject.

If the storage purpose ceases to apply or any legal storage period expires, the personal data will be blocked or deleted routinely and in accordance with legal requirements.

10. Legal basis for processing

No data is processed without a legal basis. The following serve as such:

- consent
- the fulfilment of a contract
- legal obligations
- the protection of a legitimate interest of LSA or a third party

11. Rights of data subjects

a) Right to confirmation

Every data subject has the right to request confirmation from the person responsible as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they can contact the person responsible at LSA at any time.

b) Right to information

Every person affected by the processing of personal data has the right to receive free information from the responsible person about the personal data stored about him and a copy of this information at any time. Information is provided about:

the purposes of processing,

• the categories of personal data that are processed,

• the recipients or categories of recipients to whom the personal data have been or will be disclosed

• the question of whether personal data has been transferred to a third country or to an international organization and, if this is the case, whether there are appropriate guarantees in connection with the transfer,

• the planned storage period or, if this is not possible, the criteria for determining this period,

• the existence of a right to correct or delete personal data concerning them or to restrict processing by the person responsible or the existence of a right to object to this processing,

• the existence of a right of appeal to a supervisory authority,

• the origin of the personal data, if they are not collected from the data subject,

• the existence of automated decision-making, including profiling and meaningful information about the logic involved, as well as the scope and intended effects of such processing for the data subject.

If a data subject wishes to exercise this right of information, they can contact the person responsible at LSA at any time.

c) Right to rectification

Every person affected by the processing of personal data has the right to request the immediate correction of incorrect personal data concerning them and, taking into account the purposes of the processing, the completion of incomplete personal data.

If a data subject wishes to exercise this right of rectification, they can contact the person responsible at LSA at any time.

d) Right to delete (right to be forgotten)

Any person affected by the processing of personal data has the right to request from the controller that the personal data concerning him or her be deleted immediately, provided that one of the following reasons applies and insofar as processing is not necessary:

The personal data was collected or otherwise processed for purposes for which they are no longer necessary.

The data subject withdraws the consent on which the processing was based and there is no other legal basis for the processing.

The data subject objects to the processing and there are no overriding legitimate reasons for the processing.

The deletion of personal data is necessary to comply with a legal obligation.

The personal data belongs to a child who has not yet reached the age of 16 or who has no consent from the owner of parental authority.

If one of the above reasons applies, and a data subject wishes to request the erasure of personal data stored by the controller, he or she may at any time contact the person responsible at LSA.

If the personal data has been made public by the responsible persons and the controllers are obliged to delete the personal data, the controllers shall take appropriate measures, including technical measures, taking into account the available technology and implementation costs, to inform other controllers who process the published personal data that the data subject has the has requested deletion of all links to this personal data or of copies or replications of this personal data, unless processing is necessary.

e) Right to restrict processing

Any person affected by the processing of personal data has the right to request the controller to restrict processing if one of the following conditions is met:

• The accuracy of the personal data is disputed by the data subject, for a period of time which enables the controller to verify the accuracy of the personal data.

• The processing is unlawful, the data subject refuses to delete the personal data and instead demands that the use of the personal data be restricted.

• The person responsible no longer needs the personal data for processing purposes, but the data subject needs them to assert, exercise or defend legal claims.

• The data subject has objected to the processing and it is not yet clear whether the legitimate reasons of the controller outweigh those of the data subject.

If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by the controller, he or she may contact the person responsible at LSA at any time.

f) Right to data portability

Every person affected by the processing of personal data has the right to receive personal data concerning him or her, which was provided by the data subject to the controller, in a structured, common and machine-readable format.

It also has the right to transfer this data to another data processor without hindrance from the controller to whom the personal data has been provided, provided that the processing is based on consent or on a contract and the processing is carried out using automated procedures, provided that the processing is not necessary for the performance of a task that is in the public interest or is carried out in the exercise of official authority vested in the controller.

Furthermore, the data subject may request that the personal data be transmitted directly from one data processor to another data processor, insofar as this is technically feasible and provided that this does not affect the rights and freedoms of other persons.

In order to assert the right to data portability, the data subject may contact the person responsible at LSA at any time.

g) Right to object

Every person affected by the processing of personal data has the right to object to the processing of personal data concerning him or her at any time. This also applies to profiling based on these provisions.

In the event of an objection, the responsible parties will no longer process the personal data, unless compelling legitimate grounds for processing can be proven which outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

In order to exercise the right to object, the data subject may directly contact the person responsible at LSA.

h) Automated decisions in individual cases, including profiling

Any person affected by the processing of personal data has the right not to be subject to a decision based exclusively on automated processing — including profiling — which has legal effect against him or similarly significantly affects him, unless the decision is necessary for the conclusion or performance of a contract between the data subject and the controller or is made with the express consent of the data subject.

If the decision is necessary for the conclusion or performance of a contract between the data subject and the controller, or is made with the express consent of the data subject, the controllers shall take appropriate measures to protect the rights and freedoms and legitimate interests of the data subject, including at least the right to obtain the action of a person on the part of the controller, to express their own position and to challenge the decision.

If the data subject wishes to assert rights with regard to automated decisions, he or she can contact the person responsible at LSA at any time.

i) Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right to withdraw consent to the processing of personal data at any time. If the data subject wishes to exercise their right to withdraw consent, they can contact the employees of the responsible person at any time.

j) Right to lodge a complaint with a supervisory authority

Any person affected by the processing of personal data has the right to lodge a complaint with the local supervisory authority responsible for the data protection of citizens about the data protection violations committed by the person responsible.

11. Linking to other websites

The LSA website links to other websites for whose content it is not responsible.

12. Collection, processing and use of personal data

12.1 Personal data

Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name and email address.

12.2 Individual advertising for you

Information that we receive from you helps us to permanently improve your service experience and to make it customer-friendly and individual for you. The information you submit and automatically generated is used to design advertising tailored to you and your interests.

For this purpose, we use existing information, such as information about your computer and connection to the Internet, operating system and platform, your service history, date and time of your visit to the homepage, articles, topics and content that you have viewed.

We use this information exclusively in pseudonymized form. By analyzing and evaluating this information, we are able to improve our website and our Internet offerings and thus send you individual advertising. This means advertising that recommends services that might actually interest you.

Our goal is to make our advertising more useful and interesting for you. Therefore, evaluating and analyzing the pseudonymized data collected from you helps us to ensure that we do not send you advertising indiscriminately. Instead, we send you advertising that matches your areas of interest. In this respect, it is also compared, for example, which of our social ads you click on to avoid unnecessary social ads being directed to you.

12.3 Contests, Market & Opinion Research

In the case of competitions, we use your data for the purpose of notifying you of prizes and advertising our offers. You may find detailed information in our terms and conditions of participation for the respective competition. We also use your data for market and opinion research.

Of course, we only use them anonymously for statistical purposes and only for LEADING SWISS AGENCIES. Your survey responses will not be shared with third parties or published without your consent. LSA uses and processes your personal data for market and opinion research exclusively for its own purposes.

13. cookies

This website uses cookies. Cookies are small text files that are stored permanently or temporarily when you visit this website. The purpose of cookies is in particular to analyze the use of this website for statistical evaluation and continuous improvements.

In your browser settings, you can deactivate cookies in whole or in part at any time. If cookies are deactivated, you may no longer be able to use all functions of this website.

13.1 What are cookies?

Cookies are small files that are stored on your data carrier and store certain settings and data for exchange with our system via your browser.

Basically, there are 2 different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period of time or indefinitely.

This storage helps us to design our websites and offers for you accordingly and makes them easier for you to use, for example by saving certain entries you make in such a way that you do not have to repeat them constantly.

13.2 Which cookies does LSA use?

Most of the cookies we use are automatically deleted from your hard drive at the end of the browser session (therefore also session cookies). In addition, we also use cookies that remain on your hard drive. On another visit, it is then automatically recognized that you have already visited us and which inputs and settings you prefer.

These temporary or permanent cookies (lifespan 1 month to 10 years) are stored on your hard drive and delete themselves after the specified period of time. These cookies in particular serve to make our website more user-friendly, effective and secure. Thanks to these files, it is possible, for example, to display information on the page that is specifically tailored to your interests.

The sole purpose of these cookies is to adapt our offer to your customer requirements in the best possible way and to make surfing with us as convenient as possible for you.

13.3 What data is stored in cookies?

The cookies used by LSA only store pseudonymous data. When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address, or similar data that would enable the cookie to be associated with you are not stored in the cookie. Based on cookie technology, we only receive pseudonymized information, for example about which pages of our website were visited, which services, articles or cases were viewed, etc.

13.4 What is onsite targeting?

The LSA website uses cookie technology to collect data to optimize our advertising and the entire online offering. This data is not used to identify you personally, but is used solely for a pseudonymous evaluation of the use of the homepage. At no time will your data be combined with the personal data stored by us.

With this technology, we can present you with advertising and/or special offers and services whose content is based on information obtained in connection with clickstream analysis (for example, advertising aimed at only viewing content on topics such as agency selection or news in recent days).

Our goal is to make our online offering as attractive as possible for you and to present you with advertising that meets your areas of interest.

13.5 Are there also cookies from third-party providers (so-called third party cookies)?

LSA uses a number of advertising partners who help make the website and our website more interesting for you. Therefore, cookies from partner companies are also stored on your hard drive when you visit the websites. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies (lifespan 14 days to 10 years) are stored on your hard drive and delete themselves after the specified period of time.

The cookies from our partner companies also contain only pseudonymous, usually even anonymous data. This includes, for example, data about which products you have viewed, which products were searched for, etc. In addition to the websites, some of our advertising partners also collect information about which pages you have visited before or which products you were interested in, for example, in order to be able to show you advertising that best meets your interests.

This pseudonymous data is never combined with your personal data. They have the sole purpose of enabling our advertising partners to address you with advertising that might actually be of interest to you.

13.6 Retargeting

Our websites use so-called retargeting technologies for this purpose. We use these technologies to make our website more interesting for you. This technology makes it possible to target Internet users who have already shown interest in our website and the offers presented there with advertising on the websites of our partners.

We are convinced that the display of personalized, interest-based advertising is generally more interesting for Internet users than advertising that has no such personal connection. These advertising materials are displayed on the websites of our partners based on cookie technology and an analysis of previous usage behavior. This form of advertising is completely pseudonymous. No user profiles are combined with your personal data.

By using our site, you agree that so-called cookies are used and that usage data from you is collected, stored and used. Furthermore, your data is stored in cookies beyond the end of the browser session and can be retrieved again, for example, the next time you visit the websites. You can withdraw this consent at any time with effect for the future by refusing to accept cookies in your browser settings.

13.7 How can you prevent cookies from being saved?

You can set your browser so that the storage of cookies is only accepted if you agree. If you only want to accept LSA cookies, but not the cookies from our service providers and partners, you can select the “Block third-party cookies” setting in your browser.

As a rule, the help function in the menu bar of your web browser shows you how to reject new cookies and turn off cookies that have already been received. Detailed information on how to adjust the settings in the browser you are using is available at the following link: https://support.norton.com/sp/de/de/home/current/solutions/v57840314_NortonM_Retail_1_de_de.

For shared computers that are set to accept cookies and Flash cookies, we recommend that you always log out completely after you have finished using them.

14. Log files

Each time you access the LSA pages, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The data records saved contain the following data: date and time of retrieval, name of the page accessed, IP address, referrer URL (origin URL from which you came to the website), the amount of data transferred, as well as product and version information of the browser used.

Users' IP addresses are deleted or anonymized after use has ended. When anonymized, the IP addresses are changed in such a way that the individual information about personal or factual circumstances can no longer be attributed to a specific or identifiable natural person, or only with a disproportionate expenditure of time, costs and effort.

We analyse these log file data sets anonymously in order to further improve our offering and make it more user-friendly, to find and correct errors more quickly and to manage server capacities. For example, it is possible to understand at what time the use of the LSA website is particularly popular and provide you with the appropriate volume of data to ensure that you make the fastest possible purchase. In addition, we can also identify and fix any errors on the LSA website more quickly by analyzing the log files.

15. Web analysis

15.1 Google Analytics

Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies,” i.e. text files that are stored on your computer and allow Google to analyze the use of our offer. The information collected by the cookie about the use of our websites (including your IP address) is usually transferred to a Google server in the USA and stored there. We would like to point out that on our websites, Google Analytics includes the code “gat. _anonymizeIp ();;” has been extended to ensure anonymized collection of IP addresses (so-called IP masking). At our request, Google will therefore only collect your IP address in abbreviated form, which ensures anonymization and does not allow any conclusions to be drawn about your identity.

If IP anonymization is activated on our websites, your IP address will be abbreviated beforehand by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and abbreviated there. Google will use this information to evaluate your use of our websites, to compile reports on website activity for us and to provide us with other services related to the use of websites and the Internet.

The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google. Google only transfers this data to third parties due to legal regulations or as part of order data processing. Under no circumstances will Google combine your data with other data collected by Google.

By using these websites, you agree to the processing of the data collected about you by Google and the method of data processing described above and the stated purpose. You can prevent cookies from being saved by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to fully use all functions of our websites.

You can also prevent Google from collecting the data generated by the cookie and related to your use of these websites (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link. You can find more information about Google Analytics and data protection at http://tools.google.com/dlpage/gaoptout?hl=de.

15.2 Facebook pixels

We use Facebook Pixel to show you ads tailored to your interests based on your activities on our website via retargeting on Facebook, Instagram, Facebook Messenger and Facebook Audience Network.

15.3 Google Remarketing Day

We use the Google Remarketing Tag to show you ads tailored to your interests based on your activities on our website via retargeting on Google AdWords, Google Display Network and YouTube.

15.4 Linkedin pixels

We use LinkedIn Pixel to display ads tailored to your interests on Linkedin based on your activities on our website via re-targeting.

15.5 Twitter pixels

We use Twitter Pixel to display ads tailored to your interests on Twitter based on your activities on our website via re-targeting.

16. social plug-ins

Our website uses social plugins (“plugins”) from various social networks. With the help of these plugins, you can share content or recommend products, for example. The plugins are activated by default on leadingswissagencies.ch.

The content of the plugin is transmitted directly from the social network to your browser and integrated by it into the website. By integrating the plugins, the social network receives the information that you have accessed the corresponding page on our website. If you are logged in to the social network, it can associate your visit with your account. If you interact with the plugins, for example by pressing the Facebook “Like” button or making a comment, the corresponding information is transmitted directly from your browser to the social network and stored there.

For the purpose and scope of data collection and further processing and use of the data by social networks, as well as your related rights and settings options to protect your privacy, please refer to the privacy policies of the respective networks or websites. Even if you are not logged in to social networks, websites with active social plug-ins can send data to the networks. An active plugin sets a cookie with an identifier every time the website is accessed. Since your browser sends this cookie without being asked every time you connect to a network server, the network could in principle create a profile of which websites the user associated with the identifier has accessed. And it would then also be entirely possible to assign this identifier to a person again later — for example when logging on to the social network later on.

We use the following plugins on our websites: Facebook, Twitter and LinkedIn. If you do not want social networks to collect data about you via active plug-ins, you can select the “Block third-party cookies” function in your browser settings. In this case, the browser does not send cookies to the server when content from other providers is embedded. With this setting, however, in addition to the plugins, other cross-site functions may no longer work.

16.1 Facebook

We use plugins from the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The link to Facebook's privacy policy can be found here: Facebook's privacy policy.

16.2 Twitter

We use plugins from the social network Twitter, which is operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA (“Twitter”). The link to Twitter's privacy policy can be found here: Twitter's privacy policy.

16.3 LinkedIn

We use plugins from the social network LinkedIn, which is operated by LinkedIn Ireland U.C. The link to LinkedIn's privacy policy can be found here: LinkedIn's privacy policy.
